• You are responsible for maintaining the security of your device and account

4. Subscription Plans and Pricing

4.1 Free Tier

• Watermarked exports
• Monthly usage limits reset periodically

4.2 Premium Plans

Monthly Subscription: $7.99 USD per month
Yearly Subscription: $59.99 USD per year

Premium features include:
• Unlimited AI edits

4.3 Free Trial

• New users may receive a free trial period for Premium features
• You will be charged after the trial ends unless you cancel
• Cancel anytime before trial ends to avoid charges
• Trial availability and duration may vary

4.4 Payment and Renewal

• All payments are processed through the applicable app store platform
• Subscriptions automatically renew unless canceled in accordance with platform policies
• Your account will be charged upon purchase confirmation
• Pricing may vary by region

5. Cancellation and Refunds

• Cancel your subscription at any time via your platform account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial periods or unused portions unless required by law
• Refund requests are subject to the applicable platform's policies
• We do not control third-party platform refund policies or decisions

6. Acceptable Use Policy

You agree NOT to use CircleAI to:

• Create illegal, harmful, or offensive content
• Generate deepfakes or misleading images intended to deceive
• Violate any person's privacy, publicity, or intellectual property rights
• Create explicit, adult, or age-restricted content
• Abuse or circumvent usage limits or subscription tiers
• Reverse engineer, decompile, or attempt to extract source code
• Use automated tools or bots to access the service

7. Intellectual Property

7.1 Your Content

• You retain all rights to photos you upload
• You grant us a temporary license to process your images through AI
• We do not claim ownership of your edited images

7.2 Our Content

• The App, its design, and all related content are owned by CircleAI
• You may not copy, modify, or distribute any part of the App
• Our trademarks and branding are protected

7.3 AI-Generated Content

• AI-edited portions of your images are generated by machine learning models
• We make no claims of ownership over AI-generated content
• You are responsible for ensuring your use of AI-generated content complies with applicable laws

8. Disclaimers and Limitations

8.1 No Warranty

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:
• Uninterrupted or error-free operation
• Specific results from AI editing
• Accuracy or quality of edited images
• Availability of any particular feature

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR:
• Loss of data or images
• Indirect, incidental, or consequential damages
• Loss of profits or revenue
• Third-party actions or content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

9. AI Service Disclaimers

• AI results are algorithmically generated and may vary
• We do not guarantee specific edit quality or accuracy
• Processing times may vary
• Service availability depends on third-party providers
• We reserve the right to change AI models, providers, or features at any time

10. Termination

We may suspend or terminate your access to the App at any time for:
• Violation of these Terms
• Abusive or fraudulent behavior
• Legal or regulatory requirements

Upon termination, your right to use the App ceases immediately. Paid subscriptions will not be refunded upon termination for cause.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting in the App. Continued use after changes constitutes acceptance of the modified Terms.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved in accordance with the laws applicable to your location. To the maximum extent permitted by law, you agree to resolve disputes through binding arbitration or in courts of competent jurisdiction.
